Terms of Service
The terms on which OPTIGATE LTD provides this website and supplies installation, certification and maintenance services.
Please read these terms carefully. They apply to your use of this website and, together with our written quotation, to any installation or maintenance work we carry out for you. Accepting a quotation means accepting these terms.
1. About us
OPTIGATE LTD is registered in England and Wales, company number 16545301, registered office 131 Vicarage Way, Colnbrook, Slough, England, SL3 0RB. In these terms "we", "us" and "OPTIGATE" mean OPTIGATE LTD, and "you" means the customer.
OPTIGATE is an installation and network engineering company. We are not an internet service provider and do not supply internet connectivity, bandwidth or tariffs.
2. Use of this website
- The website is provided for information. Package descriptions, prices and timings are indicative until confirmed in a written quotation.
- You may view, download and print pages for your own use in evaluating our services. You may not republish, sell or systematically extract the content.
- You must not attempt to gain unauthorised access to the site or its hosting, introduce malicious code, or use it in any unlawful way.
- We aim to keep the site available and accurate but do not guarantee uninterrupted availability or that every detail is free of error.
3. Quotations and formation of contract
- An enquiry or a form submission is not a booking. It is an invitation for us to quote.
- We normally carry out a site survey before issuing a fixed quotation. The survey establishes the route, the distances and any complications.
- A quotation is valid for 30 days unless it states otherwise.
- A contract is formed when you accept the quotation in writing (including by email) and we confirm an installation date.
- The quotation, these terms and the agreed scope form the entire agreement between us for that job.
4. Prices and payment
- Package prices are fixed for the scope described in the quotation. Additional work requested after acceptance is quoted separately before it is carried out.
- Published add-on prices — additional points, additional cable, extra nodes, concealed routing, emergency attendance and maintenance — apply as listed unless your quotation states otherwise.
- VAT treatment is stated on the quotation and invoice.
- For residential work, payment is due on completion unless agreed otherwise. For commercial projects, a deposit may be required before materials are ordered, with the balance due on completion.
- Invoices are payable within the period stated on the invoice. Late payment may attract interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 where the customer is a business.
- Title in any hardware supplied passes to you on full payment. Risk passes on installation.
5. Scope of works
Each package defines what is included — cable length, number of connection points, hardware, certification and warranty term. Anything outside that definition is an additional item. Where a survey reveals that the property requires more than the package covers, we will tell you the additional cost before starting, and you decide whether to proceed.
Where we identify pre-existing defects — damaged ducting, unsafe wiring, damp, asbestos-containing materials — we will stop and inform you rather than build over them. Remedial work by others may be required before we can continue.
6. Your obligations
- Provide safe and reasonable access to the property and to the areas where work is required at the agreed times.
- Clear the work areas of furniture, stock and valuables, or agree with us in advance who moves them.
- Provide access to mains power and, where relevant, to communal risers, meter cupboards and roof spaces.
- Tell us in advance about anything hazardous or unusual, including asbestos surveys, listed status, alarm systems and underfloor heating.
- Ensure a responsible adult is present for residential installations, or nominate a site contact for commercial work.
If we attend at an agreed time and cannot start because access is not available, we may charge a reasonable abortive-visit fee.
7. Consents and permissions
You are responsible for obtaining any consent needed for the work — from a landlord, freeholder, managing agent, building control, planning authority or, for listed buildings, the relevant conservation body. We can supply route drawings and a method statement to support an application. We are not liable for work being delayed or refused where consent has not been granted.
8. Scheduling, delays and variations
- Durations quoted — 2–3 hours, 4–6 hours, 1–2 days — are estimates based on the survey and normal conditions.
- If the work cannot be completed in the scheduled window for reasons outside our control, we will agree a return visit at the earliest mutually convenient time.
- Variations requested on the day are only binding once confirmed in writing, including the effect on price and timescale.
9. Warranty
- OPTIGATE Start carries a 12 month warranty; OPTIGATE Home Pro carries a 24 month warranty, each running from the date of completion.
- The warranty covers our workmanship and the components we supplied: splices, terminations, cable runs, mounting, patching and configuration.
- Manufacturer warranties on active hardware apply in addition and are passed through to you.
- The warranty does not cover: physical damage after handover; alterations or repairs carried out by others; power surges, flooding, fire or pest damage; changes made by your internet provider; or faults in equipment we did not supply or install.
- To claim, report the fault to us with the site reference. Where the fault is covered, we attend and rectify at no charge. Where investigation shows the cause is outside the warranty, our standard call-out and repair rates apply, and we will tell you before charging.
- Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015.
10. Business SLA and maintenance
- OPTIGATE Business Fibre includes a 12 month support agreement with a 24 hour response target for reported faults and two engineer call-outs included per year.
- "Response" means acknowledgement and the start of diagnosis, which may be remote. It is not a guaranteed fix time, as resolution can depend on third parties such as your connectivity provider.
- Additional call-outs beyond those included are charged at our published rates.
- Annual maintenance contracts are billed yearly in advance and renew only if you confirm renewal.
11. Cancellation
Consumers
Where the contract is concluded away from our premises or at a distance, you have the right to cancel within 14 days of the contract being formed, without giving a reason. If you ask us to begin work within that period and then cancel, you must pay for what has already been supplied. Once the installation is complete with your agreement, the cancellation right ends.
Business customers
Cancellation after acceptance may incur charges for materials already ordered or made bespoke, and for booked engineer time that cannot be re-allocated. We will always tell you the figure before applying it.
Cancellation by us
We may cancel where access cannot be given, where consent is refused, where the site is unsafe, or where payment terms are not met. In that case you pay only for work properly carried out up to that point.
12. Liability
- We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
- We are responsible for loss or damage that is a foreseeable result of our breach. We are not responsible for loss that is not foreseeable.
- Where you are a business, we are not liable for loss of profit, loss of business, loss of contracts, loss of data or indirect or consequential loss, and our total liability for any claim is limited to the total price paid for the work in question.
- We are not liable for the performance of your internet service, for third-party equipment we did not supply, or for interruptions caused by your provider.
- We hold appropriate insurance for our activities; details are available on request.
13. Intellectual property
The content, design, illustrations and code of this website belong to OPTIGATE LTD or its licensors. Network schematics, route drawings and certification reports produced for your project are supplied for use in relation to that property; the underlying methods and templates remain ours.
14. Events beyond our control
We are not in breach of these terms where performance is prevented or delayed by events beyond our reasonable control, including severe weather, utility failures, supply-chain disruption, industrial action, civil emergency or restrictions imposed by an authority. We will tell you promptly and agree a revised date. If the delay is substantial, either party may end the contract, and you pay only for work already carried out.
15. Complaints
If something is wrong, tell us first — most issues are resolved quickly. Write to OPTIGATE LTD, 131 Vicarage Way, Colnbrook, Slough, England, SL3 0RB, or email OPTIGATEUK@outlook.com. We acknowledge complaints within five working days and aim to resolve them within 30 days.
16. General
- If any provision of these terms is found to be unenforceable, the remaining provisions continue in force.
- A delay in enforcing a right is not a waiver of it.
- You may not transfer your rights under the contract without our written agreement. We may transfer ours to a successor of the business, provided your rights are not reduced.
- A person who is not a party to the contract has no right to enforce it.
- We may update these terms. The version in force is the one published when your quotation was issued.
17. Governing law and jurisdiction
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
